Art\u0131k internet eri\u015fimi olan \u00e7abucak her t\u00fcketici; \u0130nstagram, Facebook, Twitter ve TikTok \u00fczere toplumsal medya platformlar\u0131ndan en az bir adedini kullan\u0131yor. \u0130\u015fte bu yayg\u0131n kullan\u0131m, vakit zaman kar\u015f\u0131m\u0131za hem <strong>hukuka <\/strong>hem de ahlaka al\u0131\u015f\u0131lmam\u0131\u015f i\u00e7eriklerin \u00e7\u0131kmas\u0131na yol a\u00e7\u0131yor. Art\u0131k edinilen bilgiler ise h\u00fck\u00fcmetin bu mevzuda yeni bir \u00e7al\u0131\u015fma ba\u015flatt\u0131\u011f\u0131n\u0131 g\u00f6steriyor.<\/p>\n<p>Habert\u00fcrk&#39;te yer alan bir habere nazaran h\u00fck\u00fcmet yetkilileri, koronavir\u00fcsle gayret kapsam\u0131nda al\u0131nacak \u00f6nlemlerle ilgili yeni bir <strong>torba yasa<\/strong> haz\u0131rl\u0131yorlar. \u0130\u015fte bu torba yasan\u0131n i\u00e7erisinde, toplumsal medya platformlar\u0131n\u0131 yak\u0131ndan ilgilendiren \u00e7ok de\u011ferli unsurlar\u0131n de oldu\u011fu tabir ediliyor. Bu ba\u011flamda\u00a0<strong>5651 <\/strong>say\u0131l\u0131 &#8220;\u0130nternet Ortam\u0131nda Yap\u0131lan Yay\u0131nlar\u0131n D\u00fczenlenmesi ve Bu Yay\u0131nlar Yoluyla \u0130\u015flenen C\u00fcr\u00fcmlerle \u00c7aba Edilmesi Hakk\u0131nda Kanun&#8221;da d\u00fczenlemeler yap\u0131lacak.<\/p>\n<p><img decoding=\"async\" src=\"https:\/\/www.webtekno.com\/images\/editor\/default\/0002\/56\/5591ad00d9ea46afd9ff7b2ba530150955d2631f.jpeg\"\/><\/p>\n<p>Edinilen bilgilere nazaran mecliste g\u00f6r\u00fc\u015f\u00fcl\u00fcp kanunla\u015fmas\u0131 beklenen torba kanunla,<strong> 5651 say\u0131l\u0131 kanuna<\/strong> yeni bir husus eklenecek. Bu unsur, \u00fclkemizde faal olarak hizmet veren ve T\u00fcrkiye&#39;de g\u00fcnl\u00fck en az 1 milyon kullan\u0131c\u0131ya sahip olan toplumsal medya platformlar\u0131na, T\u00fcrkiye&#39;de temsilci bulundurma ve T\u00fcrkiye&#39;deki kullan\u0131c\u0131lar\u0131n bilgilerini<strong> T\u00fcrkiye&#39;de depolama\u00a0<\/strong>zarurili\u011fi getirilecek.<\/p>\n<p>H\u00fck\u00fcmet yetkililerinin bu t\u00fcrl\u00fc bir husus \u00fczerinde \u00e7al\u0131\u015f\u0131yor olmas\u0131n\u0131n alt\u0131nda \u00e7ok k\u0131ymetli bir neden yat\u0131yor. O denli ki hukuka kar\u015f\u0131t olarak yap\u0131lm\u0131\u015f olan bir payla\u015f\u0131m\u0131n kald\u0131r\u0131lmas\u0131, ilgili toplumsal medya platformunun T\u00fcrkiye&#39;de temsilcisi olmamas\u0131 durumunda <strong>zorla\u015f\u0131yor<\/strong>. Zira mevcut i\u015fleyi\u015fte muhatap bulunam\u0131yor, bulunsa da bu \u00e7ok uzun s\u00fcr\u00fcyordu. Platformlar\u0131n T\u00fcrkiye temsilcileri olmas\u0131 ise\u00a0hukuka ters i\u00e7eriklerle <strong>daha s\u00fcratli<\/strong> gayret edilmesini sa\u011flayacak.<\/p>\n<p><img decoding=\"async\" src=\"https:\/\/www.webtekno.com\/images\/editor\/default\/0002\/56\/d161b6ca34d096c3356b7acef46ad0ff23e05ab1.png\"\/><\/p>\n<p>Torba yasa tasla\u011f\u0131ndaki bu hususun kabul edilip, y\u00fcr\u00fcrl\u00fc\u011fe girmesi ile birlikte toplumsal medya devleri, yetkili isimlerinden bir adedini <strong>T\u00fcrkiye temsilcisi <\/strong>olarak atayacaklar. Yap\u0131lacak olan bu atama sonunda T\u00fcrkiye temsilcisi olan ki\u015finin kimlik ve ba\u011flant\u0131 bilgileri, <strong>BTK<\/strong>&#39;ya iletilecek. T\u00fcrkiye maddelerine ters olan i\u00e7erikler tespit edildi\u011finde de direkt bu isim ile irtibata ge\u00e7ilecek.<\/p>\n<p><b>Temsilci bildirmeyen toplumsal medya platformlar\u0131na trafi\u011fi k\u0131s\u0131tlama ve para cezas\u0131 verilecek<\/b><\/p>\n<p>Edinilen bilgilere nazaran \u015fayet kelam konusu torba yasa tasar\u0131s\u0131 kanunla\u015f\u0131rsa, BTK tek tek bu toplumsal medya platformlar\u0131na bildirim g\u00f6nderecek bu bildirimde hem bilgi verilip hem de <strong>30 g\u00fcn<\/strong> m\u00fcddet tan\u0131nacak. Kelam konusu platform, bu bir ayl\u0131k s\u00fcre\u00e7 i\u00e7erisinde temsilci belirleyip bunu BTK&#39;ya bildirmezse, ilgili toplumsal medya platformunun trafi\u011fi <strong>y\u00fczde 95<\/strong>&#39;e kadar k\u0131s\u0131lacak. Gereklilikler yerine getirildi\u011finde trafik tekrar eski haline d\u00f6necek.<\/p>\n<p><img decoding=\"async\" src=\"https:\/\/www.webtekno.com\/images\/editor\/default\/0002\/56\/864fe02fdc1164c912225b8c03249a45281fffc1.jpeg\"\/><\/p>\n<p>Yeni husus ile T\u00fcrkiye&#39;de hukuka al\u0131\u015f\u0131lmam\u0131\u015f oldu\u011fu tespit edilen i\u00e7erikler i\u00e7in 72 saat m\u00fcddet verilecek. \u015eayet kelam konusu toplumsal medya platformunun\u00a0T\u00fcrkiye temsilcisi, bu i\u00e7eriklerle ilgili 72 saat i\u00e7erisinde rastgele bir bildirimde bulunmaz ise 100 bin TL\u00a0 ile <strong>1 Milyon TL<\/strong> aral\u0131\u011f\u0131nda idari para cezas\u0131 kesilecek. B\u00f6ylece bu cezaya maruz kalmak istemeyen platformlar, hukuka kar\u015f\u0131t i\u00e7erikle ilgili \u00e7al\u0131\u015fmas\u0131n\u0131<strong> 72 saat<\/strong> i\u00e7inde tamamlam\u0131\u015f olacaklar.<\/p>\n<p>Haberimizin ba\u015f\u0131nda, kelam konusu torba yasa ile birlikte toplumsal medya platformlar\u0131na T\u00fcrkiye&#39;deki kullan\u0131c\u0131lar\u0131n <strong>datalar\u0131n\u0131n <\/strong>T\u00fcrkiye&#39;de tutulmas\u0131 gerekti\u011fi ile ilgili bir mevzu daha oldu\u011fundan bahsetmi\u015ftik. Edinilen bilgiler, bu kurala uymayan toplumsal medya platformlar\u0131na <strong>5 milyon TL<\/strong>&#39;ye kadar idari para cezas\u0131 kesilece\u011fi istikametinde.
